The Notice clearly points out that according to Article 51 of the Labor Law, employers must pay wages on statutory holidays in accordance with the law. That is to say, employees should be paid even if they do not work on the 11 holidays. Excluding the 104 weekends that are not paid, the number of paid days per month should be (365-104)/12, or 21.75 days. The daily wage level is then calculated by dividing the monthly wage income by 21.75. Taking Beijing’s average monthly wage of 3,008 yuan as an example, workers’ overtime work on holidays should be paid triple or double wages based on 138.3 yuan.
(II) Salaried Days <br /> Regarding the question of whether an extra day of holidays will affect overtime pay, a lawyer from a Beijing law firm confirmed that "The Notice clarifies a concept, namely 'monthly paid days'. Overtime pay calculation standards:
Statutory holidays: overtime pay shall be paid at a rate not lower than 300% of the employee’s average daily wage or hourly wage in the previous month. Public holidays: overtime pay shall be paid at a rate not lower than 200% of the employee’s average daily wage or hourly wage in the previous month. According to the standards, overtime pay on June 25 shall be paid at a rate not lower than 300% of the employee’s daily or hourly wage, and shall not be replaced by compensatory leave, etc.
June 26 and June 27 are rest days. Employers who arrange overtime work for employees on rest days can arrange compensatory leave for the employees, but do not need to pay overtime wages. If no compensatory leave is given, overtime wages should be paid at a rate not less than 200% of the employee's daily or hourly wage.
